It is Ordered that the motion for various relief is denied, without prejudice. The issue of the settlement of the transcript must be raised before the trial court. The court notes that the stay has lapsed and the appellant has failed to comply with the June 30, 2005 order of this court. Therefore, until the appeal is perfected, as required by three prior orders of this Court and by the Rules of this Court, and until the arrears outstanding [$5,160.oo] have been tendered to the landlord, the stay will not be re-instated. The papers submitted as a cross-motion, not having been timely served, were considered solely in opposition to the motion [ see CPLR § 2215 and 2103(b)(2) ].
