Foreclosure Answer Program

A foreclosure is a lawsuit where a mortgage Lender or servicer is asking the court to let them sell your house at auction in order to pay off your debt. If that happens, you could lose your home. The Answer is your response to the Summons and Complaint and tells the court your defenses or reasons why the mortgage Lender must not win the case.   [Learn more about Foreclosure]

You can use this program if:

  • You have not answered already, and
  • the property is in New York State.

It is a good idea to talk to a lawyer before filing any legal papers. There is free help available to homeowners in New York State. Connect with a legal services provider at 855-HOME-456 (855-466-3456) or https://www.homeownerhelpny.com/get-help to get help. See Foreclosure Resources.

COVID-19 Financial Hardship:
If you have lost income or had increased expenses during the COVID‑19 pandemic, you may be able to "stay" (delay) the foreclosure case until January 15, 2022. Complete the Foreclosure Hardship Declaration form, make a copy for your records, and return it to the court where the foreclosure case has been filed.

The Foreclosure Hardship Declaration is also available in other languages.
