I. The Court is open for in person appearances.

All court proceedings are in person only. If there are extenuating circumstances, as an accommodation, the Court may permit virtual appearances on certain calendar calls and conferences. Please make an application through the appropriate Surrogate’s Court Department for such an accommodation. All virtual appearances will be conducted via Microsoft TEAMS. Please refer to Part Rules Section 4B for additional information.

VI. STATUTE OF LIMITATIONS ISSUES AND OTHER URGENT MATTERS

For proceedings that have a statute of limitations approaching, attorneys shall commence the proceeding by filing via NYSCEF. Unrepresented parties may e-file via NYSCEF, or mailing via USPS mail service or hand-delivery to the appropriate department of the Surrogate’s Court. Parties shall outline the details of such urgency in the form of an affidavit and/or affirmation. [email protected]

  2. Attach a copy of the affirmation of urgency that was filed and indicate the date of filing. 
  3. DO NOT email any other email box. 

Proposed Decrees, Supplemental Citations, Applications and Proposed Orders for Substituted Service – must be filed with the Court at least two days before return date. The Court shall issue Decrees in uncontested probate and administration proceedings; proposed Decrees shall no longer be necessary in these instances.
