Judgments, Supreme Court, New York County (Gregory Carro, J.), rendered December 11, 2024, unanimously modified, as a matter of discretion in the interest of justice, to the extent of vacating the surcharges and fees imposed on defendant at sentencing, and otherwise affirmed. Although we find that defendant did not make a valid waiver of his right to appeal, we perceive no basis for reducing the sentences. However, based on our own interest of justice powers, we vacate the mandatory surcharges and fees imposed on defendant at sentencing (People v Chirinos, 190 AD3d 434 [1st Dept 2021]).
