[*1]DECISION & ORDER ON MOTION FOR REINSTATEMENT
Motion by Kenneth B. Schwartz for reinstatement to the Bar as an attorney and counselor-at-law. Schwartz was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on May 30, 1984. By opinion and order of this Court dated August 7, 2019, Schwartz was suspended from the practice of law for two years, commencing September 6, 2019 (see Matter of Schwartz, 176 AD3d 57). By decision and order on motion dated April 12, 2022, Schwartz's first motion for reinstatement was held in abeyance, and the matter was referred to a Committee on Character and Fitness to investigate and report on his character and fitness to practice law.
Upon the papers filed in support of the motion and the papers filed in relation thereto, and upon the report of the Committee on Character and Fitness, the exhibits annexed thereto, and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
We find that Kenneth B. Schwartz does not demonstrate the requisite character and fitness to practice law.
