Appeal from a judgment of the County Court, Nassau County, rendered June 14, 2023. Motion by the appellant's assigned counsel for leave to withdraw a brief filed pursuant to Anders v California (386 US 738), and, in effect, for leave to file a replacement brief.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted and the brief filed by assigned counsel pursuant to Anders v California (386 US 738), is stricken; and it is further,
ORDERED that the appellant's time to perfect the appeal is extended; assigned counsel shall prosecute the appeal expeditiously in accordance with this Court's rules (see 22 NYCRR 1250.9) and written direction.
