Appeals from two orders of the Supreme Court, Nassau County, dated January 22, 2025, and September 2, 2025, respectively. Motion by Rallye Motors LLC, Rallye Motors Holding LLC, and Juliana Terian for leave to appeal to this Court from an order of the same court dated January 21, 2025. Separate motion by Rallye Motors LLC, Rallye Motors Holding LLC, and Juliana Terian to stay discovery in the above-entitled action, pending hearing and determination of the appeal from the order dated January 21, 2025. Separate motion by Rallye Motors LLC, Rallye Motors Holding LLC, and Juliana Terian for leave to appeal to this Court from the order dated September 2, 2025. Separate motion by Rallye Motors LLC, Rallye Motors Holding LLC, and Juliana Terian for leave to file a replacement brief on the appeal from the order dated January 22, 2025.

Upon the papers filed in support of the motions for leave to appeal to this Court from the order dated January 21, 2025, to stay discovery in the above-entitled action, pending hearing and determination of the appeal from the order dated January 21, 2025, and for leave to appeal to this Court from the order dated September 2, 2025, and the papers filed in opposition thereto, and upon the papers filed in support of the motion for leave to file a replacement brief on the appeal from the order dated January 22, 2025, and no papers having been filed in opposition or relation thereto, it is

ORDERED that the motion for leave to file a replacement brief on the appeal from the order dated January 22, 2025, is granted and on or before April 8, 2026, Rallye Motors LLC, Rallye Motors Holding LLC, and Juliana Terian shall serve and file a replacement brief that contains a "questions presented" page and is in all other respects the same as the brief previously filed, via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the replacement brief and upload digital copies of the replacement brief, with proof of service thereof, through the digital portal on this Court's website; and it is further,

ORDERED that the motion for leave to appeal to this Court from the order dated January 21, 2025, and the motion for leave to appeal to this Court from the order dated September 2, 2025, are denied; and it is further

ORDERED that the appeal from the order dated September 2, 2025, purportedly taken as of right is dismissed, without costs or disbursements; and it is further,

ORDERED that the motion to stay discovery in the above-entitled action, pending hearing and determination of the appeal from the order dated January 21, 2025, is denied as academic.
