Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED, on the court's own motion, that the appeal is dismissed as academic since the final judgment was subsequently vacated by decision and order of the Justice Court dated November 25, 2025 (see Barnes v Oceanus Nav. Corp., Ltd., 21 AD3d 975 [2005]); and it is further,
ORDERED that the motion is denied as moot.
