[*1]DECISION & ORDER ON MOTION FOR REINSTATEMENT
Motion by Timothy F. Daly for reinstatement to the Bar as an attorney and counselor-at-law and acceptance of his affidavit of compliance filed pursuant to 22 NYCRR 1240.15 nunc pro tunc. Daly was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on October 19, 1994. By decision and order on motion of this Court dated January 6, 2012, as amended January 20, 2012, Daly was immediately suspended upon a finding that he was guilty of professional misconduct immediately threatening the public interest. By opinion and order of this Court dated July 24, 2013, Daly was disbarred, effective immediately, upon his default, and his name was stricken from the roll of attorneys and counselors-at-law (see Matter of Daly, 109 AD3d 276).
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is denied, the affidavit of compliance filed by Timothy F. Daly is accepted for filing, and is deemed to be filed on October 29, 2024.
We find that Timothy F. Daly does not demonstrate the requisite character and fitness to practice law.
