On the Court's own motion, it is
ORDERED that the order to show cause of this Court dated February 2, 2026, in the above-entitled case is recalled and vacated, and the following order to show cause is substituted therefor:
Appeal from an order of the Supreme Court, Richmond County, dated February 22, 2022. By decision and order on motion of this Court dated February 27, 2023, the appellant was directed to serve and file a replacement appendix on or before March 29, 2023. The appellant has not filed the replacement appendix.
Now, on the Court's own motion, it is
ORDERED that the parties to the appeal are directed to show cause before this Court why an order should or should not be made and entered dismissing the appeal in the above-entitled action for failure to comply with the decision and order on motion of this Court dated February 27, 2023, by serving and filing, via NYSCEF, a digital copy of an affirmation or an affidavit on that issue on or before May 11, 2026; and it is further,
ORDERED that the Clerk of this Court, or his designee, is directed to serve a copy of this order to show cause upon counsel by uploading a copy of this order to show cause to the NYSCEF system.
