[*1]DECISION & ORDER ON MOTION
Proceeding pursuant to CPLR article 78 in the nature of mandamus to compel the respondent Evelyn Braun, a Justice of the Supreme Court, Queens County, to grant the petitioner permission to file a motion and to determine that motion in a matter entitled People v Johnson, pending in that court under Indictment Nos. 5837/86 and 5908/87, which was determined by decision, order and judgment of this Court dated June 21, 2023. Motion by the petitioner, inter alia, in effect, for leave to reargue the proceeding, or, in the alternative, for leave to appeal to the Court of Appeals from decision, order and judgment of this Court.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
