[*1]DECISION & ORDER ON MOTION
Appeal from a judgment of the County Court, Suffolk County, rendered June 6, 2024. Motion by the appellant's assigned counsel to be relieved on the ground that the appellant has abandoned the appeal by failing to respond to communications by assigned counsel. Separate motion by the appellant's assigned counsel to abate the appeal upon the death of the appellant on July 24, 2024.
Upon the papers filed in support of the motions and the papers filed in relation thereto, it is
ORDERED that the motion to abate the appeal is granted, the appeal is dismissed, and the matter is remitted to the County Court, Suffolk County, for further proceedings consistent with People v Mintz (20 NY2d 770); and it is further,
ORDERED that the motion by the appellant's assigned counsel to be relieved is denied as academic.
