[*1]DECISION & ORDER ON MOTION
Appeal from an order of the Supreme Court, Kings County, dated August 1, 2024. Motion by the nonparty-respondent to extend the time to serve and file a brief. By order to show cause dated August 27, 2025, the parties were directed to show cause before this Court why the appeal should or should not be made and entered dismissing the appeal in the above-entitled action on the ground that no appeal lies from an order denying reargument and/or on the ground that the appellants are not aggrieved by the order (see CPLR 5511), and the motion by the nonparty-appellant was held in abeyance in the interim.
Now, upon the order to show cause and no papers having been filed in response thereto, and upon the papers filed in support of the motion by the nonparty-appellant and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion to dismiss the appeal is granted and the appeal is dismissed, without costs or disbursements, on the ground that no appeal lies from an order denying reargument and on the ground that the appellants are not aggrieved by the order (see CPLR 5511); and it is further,
ORDERED that the motion by the nonparty-respondent is denied as academic.
