[*1]DECISION & ORDER ON MOTION
Appeal from an order of the Family Court, Kings County, dated June 13, 2024. Motion by the attorney for the child to direct the appellant to furnish the attorney for the child with the transcripts of certain proceedings, and to extend the time to serve and file a brief.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to direct the appellant to furnish the attorney for the child with the transcripts of certain proceedings is granted to the extent that the decision and order on motion of this Court dated January 10, 2025, which granted waiver of costs, fees, and expenses to the appellant, is amended to include a direction that the stenographer(s) and/or the transcription service(s) is/are required to make and certify two transcripts of the stenographic minutes of the proceedings which occurred in the Family Court, Kings County, on September 7, 2022, September 15, 2022, and April 18, 2023, in the above-entitled matter, if any, except for those minutes previously transcribed and certified (22 NYCRR 671.9); in the case of stenographers, both transcripts shall be filed with the clerk of the Family Court, and the clerk of the Family Court shall furnish one of such certified transcripts to the appellant's assigned counsel, without charge; in the case of transcription services, one transcript shall be filed with the clerk of the Family Court and one transcript shall be delivered to the appellant's assigned counsel. The appellant's assigned counsel is directed to provide copies of said transcripts to all of the other parties to the appeal, including the attorney for the child, within 15 days of receipt of said transcripts; and it is further,
ORDERED that the branch of the motion which is to extend the time to serve and file a brief is granted, and on or before June 22, 2026, the attorney for the child shall serve and file a brief via NYSCEF, if applicable, or if NYSCEF is not mandated, serve the brief and upload a digital copy of the brief, with proof of service thereof, through the digital portal on this Court's website; and it is further,
ORDERED that the attorney for the child is directed to serve a copy of this decision and order on motion upon the clerk of the court from which the appeal is taken; and it is further,
ORDERED that the motion is otherwise denied.
