[*1]Appeal from an order of the Civil Court of the City of New York, Kings County, dated April 30, 2024. By order to show cause dated December 20, 2024, an order was issued directing the parties to show cause before this court why an order should or should not be made and entered dismissing the appeal on the ground that the appeal was not properly taken. That order to show cause was inadvertently not served upon respondents-appellants.
On the court's own motion, it is
ORDERED that respondents-appellants' time to respond to this court's December 20, 2024 order to show cause is enlarged and respondents-appellants are directed to show cause before this court why the appeal should not be dismissed on the ground that the appeal was not properly taken in that respondents-appellants failed to serve the notice of appeal upon petitioners Kate Klenfner, Ky Jensen Stewart, and Abigail Puritz (see CPLR 5515 [1]) and no application has been made pursuant to CPLR 5520 (a) to cure the defect, by filing an affidavit or affirmation on that issue with the Clerk of this court on or before May 15, 2026; and it is further,
ORDERED that the Clerk of this court, or her designee, is directed to serve a copy of this
order to show cause on all parties to the proceeding by regular mail.
