[*1]Motion by appellant to extend the time to perfect an appeal from a judgment of conviction of the Justice Court of the Town of Wallkill, Orange County, rendered October 1, 2024.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED, on the court's own motion, that appellant's time to serve copies of the notice of appeal upon the District Attorney of Orange County and the Town of Walkill Prosecutor (c/o Walkill Town Court, 99 Tower Drive, Building B, Middletown, NY 10941) is enlarged to 15 days from the date of this decision and order (see CPL 460.10 [6]), and appellant shall file proof of such service with this court within 5 days of such service; and it is further,
ORDERED that the motion is granted and the appeal shall be perfected on or before June 22, 2026; and it is further,
ORDERED that in the event proof of service of the notice of appeal in accordance with this decision and order is not filed with this court or the appeal is not perfected by June 22, 2026, the court, on its own motion, may dismiss the appeal, or respondent may move, on three days' notice, to dismiss the appeal, and may, if appellant is unrepresented, serve such application upon appellant in person.
The notice of appeal in this case was served on a court clerk.
