Appeal from an order of the Supreme Court, Nassau County, dated October 16, 2025. Motion by the appellant to stay the trial in the above-entitled action, pending hearing and determination of the appeal. Motion by the respondent to dismiss the appeal on the ground that the appeal was untimely taken. Cross-motion by the appellant, in effect, to deem the notice of appeal to be timely filed.
Upon the papers filed in support of the motion to stay the trial and no papers having been filed in opposition or in relation thereto, and upon the papers filed in support of the motion to dismiss the appeal and the cross-motion and the papers filed in opposition thereto, it is
ORDERED that the motion by the respondent is granted, and the appeal is dismissed (see CPLR 5513), without costs or disbursements; and it is further,
ORDERED that the cross-motion is denied; and it is further,
ORDERED that the motion by the appellant is denied as academic.
