Appeal from a judgment of the County Court, Orange County, rendered December 15, 2021. Motion by the respondent, in effect, to dismiss the appeal for failure to comply with 22 NYCRR 670.11(a), or, in the alternative, to direct the appellant to produce transcripts pursuant to 22 NYCRR 670.11(a), and to extend the time to serve and file a brief.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to dismiss the appeal is denied; and it further,
ORDERED that the branch of the motion which is to direct the appellant to produce transcripts pursuant to 22 NYCRR 670.11(a) is denied as academic as the transcripts have been produced; and it is further,
ORDERED that the branch of the motion which is to extend the time to serve and file a brief is denied as unnecessary as the respondent's brief was timely filed.
