[*1]Motion by appellant for an extension of time to perfect an appeal from a final judgment of the Civil Court of the City of New York, Kings County, entered June 11, 2024. Cross-motion by respondent to dismiss the appeal or, in the alternative, to direct appellant to pay ongoing use and occupancy pending the determination of the appeal.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the motion seeking an extension of time to perfect the appeal is granted, and the appeal shall be perfected or on before May 29, 2026; and it is further,
ORDERED that in the event the appeal is not perfected by May 29, 2026, the court, on its own motion, may dismiss the appeal, or respondent may move, on three days' notice, to dismiss the appeal, and if the appellant is unrepresented, may serve such motion upon the appellant in person; and it is further,
ORDERED that the cross-motion is denied.
