[*1]Defendant having moved pursuant to CPL 460.10 (6) (denominated a motion for a writ of error coram nobis) to treat a notice of appeal as valid as to the appeal taken herein from a judgment of the Supreme Court, Monroe County, rendered May 8, 2023,
Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted, and the notice of appeal filed in the Monroe County Clerk's Office on May 25, 2023, which lists the indictment number as 71566-22/001, shall be treated as valid as to indictment number 70450-23/001, pursuant to CPL 460.10 (6).
