Appeal from an order of the Family Court, Dutchess County, dated September 23, 2025. Motion by the appellant to deem the notice of appeal to be timely served and filed, for waiver of costs, fees, and expenses, and for the assignment of counsel.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to deem the notice of appeal to be timely served and filed is denied; and it is further,
ORDERED that on the Court's own motion, the appeal is dismissed, without costs or disbursements, as untimely taken (see Family Ct Act § 1113); and
ORDERED that the branches of the motion which are for waiver of costs, fees, and expenses and for the assignment of counsel are denied as academic.
