Appeal from a judgment of the Supreme Court, Nassau County, dated January 11, 2024. Motion by the respondents pursuant to CPLR 1021 to dismiss the appeal for failure to substitute a personal representative for the deceased appellant Madeline Mannino upon her death on February 14, 2024.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied without prejudice to renew upon proper papers, including proof of proper service upon all persons interested in the decedent's estate (see CPLR 1021).
