[*1]DECISION & ORDER ON MOTION
Appeal from an order of the Supreme Court, Queens County, dated November 18, 2025. Motion by the appellant, inter alia, in effect, to deem the notice of appeal to be timely filed. Separate motion by the appellant to stay enforcement of the order, pending hearing and determination of the appeal.
Upon the papers filed in support of the motions and the papers having been filed in opposition thereto, it is
ORDERED that the branch of the motion which is to deem the notice of appeal to be timely filed is denied as unnecessary as the papers filed in connection with the motion do not reflect that the notice of appeal was untimely filed (see CPLR 5513[a]); and it is further,
ORDERED that the motions are otherwise denied.
CHAMBERS, J.P., FORD, QUIRK and OTTLEY, JJ., concur.
