[*1]Motion by appellant for a stay of eviction pending the determination of an appeal from a decision of the Justice Court of the Town of Clarkstown, Rockland County, dated February 24, 2026, and an order of that court dated April 16, 2026.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted on condition that appellant pay ongoing use and occupancy to respondent on a weekly basis at a weekly rate of $345 as it becomes due, and to file proof of each payment with this court on a monthly basis by the 5th day of the month; and it is further,
ORDERED that in the event any of the above conditions are not met, the court, on its own motion, may vacate the stay, or respondent may move, on three days' notice, to vacate the stay, and may serve such application upon appellant in person.
