[*1]DECISION & ORDER ON MOTION
Appeals from three orders of the Supreme Court, Westchester County, dated December 20, 2024, January 29, 2025, and January 22, 2025, respectively. Motion by the respondents, inter alia, to dismiss the appeals by Love Tracts Witnessing Center, Inc. on the ground that Love Tracts Witnessing Center, Inc., failed to appear by an attorney (see CPLR 321[a]), and to dismiss the appeals on the ground that the record is inadequate, or, in the alternative, to extend the time to serve and file a brief. Motion by the appellants, inter alia, in effect, to dismiss the motion by the respondent on the ground that it is premature. Separate motion by the appellants, inter alia, in effect, for a preference in the calendaring of the appeals.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion by the respondents which is to dismiss the appeals by Love Tracts Witnessing Center, Inc., on the ground that Love Tracts Witnessing Center, Inc., failed to appear by an attorney (see CPLR 321[a]), is held in abeyance and referred to the panel of Justices hearing the appeals for determination upon the argument or submission thereof; and it is further,
ORDERED that the branch of the motion by the respondents which is to dismiss the appeals on the ground that the record is inadequate is granted to the extent that on or before July 13, 2026, the appellants shall serve and file a supplemental record containing all papers filed in connection with the motion that resulted in the order dated December 20, 2024, and Supreme Court NYSCEF Document Nos. 29, 30, 33, 34, 42, 43, 47-52, 58, 59, 66, 67, 70, 71, 74, 75, 78, 79, 82 and 83, via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the supplemental record and upload a digital copy of the supplemental record, with proof of service thereof, through the digital portal on this Court's website and that branch of that motion is otherwise denied; and it is further,
ORDERED that the branch of the motion by the respondents which is to extend the time to serve and file a brief is granted, and on or before August 13, 2026, the respondents shall serve and file the respondents' brief via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the brief and upload a digital copy of the brief, with proof of service thereof, through the digital portal on this Court's website; and it is further,
ORDERED that the motion by the respondents is otherwise denied; and it is further,
ORDERED that the motions by the appellant are denied.
