Appeal from an order of the Supreme Court, Rockland County, dated May 6, 2025. Motion by the respondents to dismiss the appeal on the ground that the appeal was untimely taken. Cross-motion by the appellant, inter alia, in effect, to deem the notice of appeal to be timely served and filed. Separate motion by the respondents to extend the time to serve and file a brief.
Upon the papers filed in support of the motion to dismiss the appeal and the cross-motion and the papers filed in opposition thereto, and upon the papers filed in support of the motion to extend the time to serve and file a brief and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the cross-motion is denied; and it is futher,
ORDERED that the motion to dismiss the appeal is granted, and the appeal is dismissed (see CPLR 5513), without costs or disbursements; and it is further,
ORDERED that the motion to extend the time to serve and file a brief is denied as academic.
