[*1]DECISION & ORDER ON MOTION
Appeal from an order of the Supreme Court, Nassau County, dated April 11, 2025. Motion by the appellant, in effect, to stay enforcement of a judgment of the same court dated January 20, 2026, including the sale of the subject property, pending hearing and determination of the appeal. Motion by the respondent to dismiss the appeal on the ground that the right of direct appeal from the order terminated upon entry in the above-entitled action of the judgment or, in the alternative, to extend the time to serve and filed a brief.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion by the respondent which is to dismiss the appeal is granted and the appeal is dismissed, (see Matter of Aho, 39 NY2d 241), without costs or disbursements; and it is further,
ORDERED that the motions are otherwise denied as academic.
