Appeals from two orders of the Supreme Court, Kings County, dated November 1, 2024, and January 21, 2025, respectively. Motion by the respondent to dismiss the appeal from the order dated January 21, 2025, on the ground that the record is inadequate, or, in the alternative, to extend the time to serve and file a brief. Separate motion by the respondent to dismiss the appeals on the ground that the records are inadequate, or, in the alternative, to consolidate the appeals, and to extend the time to serve and file a brief.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the branches of the motions which are to dismiss the appeal from the order dated January 21, 2025, are granted to the extent that on or before August 10, 2026, the appellant shall serve and file a supplemental record containing Supreme Court NYSCEF Document Nos. 6 through 13 and 56, via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the supplemental record and upload a digital copy of the supplemental record, with proof of service thereof, through the digital portal on this Court's website, and those branches of the motions are otherwise denied; and it is further,
ORDERED that the branch of the motion which is to dismiss the appeal from the order dated November 1, 2024, is denied; and it is further,
ORDERED that the branch of the motion which is to consolidate the appeals is denied; and it is further,
ORDERED that on the Court's own motion, the appeals will be calendared together and will be argued or submitted on the same date; and it is further,
ORDERED that the branches of the motions which are to extend the time to serve and file briefs are granted, and on or before September 8, 2026, the respondent shall serve and file the respondent's briefs via NYSCEF, if applicable, or, if NYSCEF is not mandated, serve the briefs and upload a digital copy of the briefs, with proof of service thereof, through the digital portal on this Court's website.
