Counsel for appellant having moved for permission to withdraw the appellate brief filed for the appeal taken herein from a judgment of the Niagara County Court, rendered October 11, 2019, for the appeal to be removed from the term of Court commencing October 19, 2026, and for new counsel to be assigned to the appeal,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks reassignment of counsel is granted, and new counsel is to be assigned to this appeal, and

It is further ORDERED that the motion insofar as it seeks to withdraw the appellate brief is granted, and both the appellant's and respondent's briefs are deemed withdrawn, and

It is further ORDERED that the motion insofar as it seeks removal of this appeal from the term of Court commencing October 19, 2026 is granted, and the Court's scheduling order, entered April 6, 2026, is vacated, and

It is further ORDERED that said records and briefs are to be filed and served on or before October 13, 2026.
