[*1]DECISION & ORDER ON MOTION
Appeals from an order of the Supreme Court, Suffolk County, dated March 5, 2026, and a judgment of the same court dated March 17, 2026. Motion by the respondent to dismiss the appeals on the ground that the appeals were untimely taken, to dismiss the appeal from the order on the ground that no appeal lies from an order denying reargument, and to dismiss the appeal from the judgement on the ground that no appeal lies from a judgment entered upon the default of the appealing party (see CPLR 5511).
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to dismiss the appeal from the judgment on the ground that no appeal lies from a judgment entered upon the default of the appealing party (see CPLR 5511) is held in abeyance and referred to the panel of Justices hearing the appeals for determination upon the argument or submission thereof; and it is further,
ORDERED that the motion is otherwise denied.
