E-filing Expansion for criminal appeals to the Appellate Division, Second Department from Kings County

The Appellate Division for the Second Judicial Department began e-filing, through the New York State Courts Electronic Filing (NYSCEF) system, in 2018. Currently, the Court requires mandatory e-filing for civil appeals in all matters originating and electronically filed in the Supreme Court, Court of Claims and Surrogate’s Court of all counties within its jurisdiction, as well as original proceedings.

Given the great success of e-filing in the Second Department thus far, as of May 1, 2026, the Court will expand mandatory appellate e-filing to all criminal appeals originating in Kings County.

The rules of the Appellate Division on electronic filing may be found at 22 NYCRR Part 1245. In addition, further information regarding technical requirements and guideline for e-filing in the Second Department is available at this link. https://www.nycourts.gov/courts/AD2/efiling/efilingrules.pdf
