New Requirements for Applications submitted to the
Appellate Division, Second Judicial Department to
Register or Re-Register as In-House Counsel

Effective January 1, 2026, there will be certain additional requirements for applications submitted to the Appellate Division, Second Judicial Department to register or re-register as in-house counsel in New York State. Applicants are now required to email a single .pdf to

containing the following:

(1) A completed application to register or re-register as in-house counsel.

(2) An affidavit in which the applicant:

(a) recites that the applicant has read and understands the current New York Rules of Professional Conduct (22 NYCRR Part 1200), and agrees to be bound by them; and

(b) describes the nature and role of the professional duties that the applicant expects to undertake as in-house counsel at the prospective employer’s corporation, partnership, association or other legal entity.

(3) Affidavits from at least two persons who have known the applicant for at least five years, explaining how the affiant knows the applicant, and attesting to the applicant’s good character and the basis of the opinion.
