The Appellate Division for the Second Judicial Department began e-filing, through the New York State Courts Electronic Filing (NYSCEF) system, in 2018. Currently, the Court requires e-filing for all appeals in all matters originating and electronically filed in the Supreme Court, Court of Claims, and Surrogate’s Court of all counties within its jurisdiction.
Given the great success of e-filing in the Second Department thus far, the Court will expand mandatory e-filing to all proceedings originating in the Second Department. E-filing of all original proceedings in the Second Department will be an available option to litigants on Monday June 3, 2024, and will be mandatory effective Monday July 1, 2024. With this expansion, all matters (except attorney matters) in the Second Department are subject to mandatory e-filing.
The rules of the Appellate Division on electronic filing may be found at 22 NYCRR Part 1245. E-filing of original proceedings is covered under Rule 1245.3(c). After registering as an authorized e-filer with NYSCEF, counsel for the petitioner (or a self-represented petitioner who wants to participate in e-filing) will be able to file all documents to commence an original proceeding and pay the filing fees. Hard copy submissions are NOT required on e-filed matters.
