This year, the primary for state and local elections will be held on June 25, 2024. By Administrative Order 2024-0308, this Court has set the schedule by which appeals relating to those elections will be heard. Pursuant to that order, the appeals will be heard on Wednesday, May 8, 2024. Oral argument will commence at 10:00 a.m. and, unless otherwise directed, will be held in-person.
All election appeals shall be perfected on or before May 1, 2024, by 5:00 p.m., and responding briefs shall be served and filed on or before May 6, 2024, by 5:00 p.m., unless otherwise directed by the Court. All briefs and relevant transcripts shall be served by e-mail, as well as e-mailed to the Court at [email protected]. For NYSCEF-filed causes, the e-mailed submissions to [email protected] MUST be followed by filing via NYSCEF. For non-NYSCEF-filed causes, the e-mailed submissions MUST be followed by filing via the digital submission portal on the Court’s website. Any associated fees not paid through NYSCEF must be sent to the Court via overnight mail in the form of a check, payable to “Clerk of the Court,” on which the Appellate Division Docket number is referenced.
In light of the limited time available between the proceedings in the trial court and the Appellate Division’s briefing schedule and election appeal calendar, parties who seek to have their appeal placed on this Court’s election appeal calendar MUST contact the Clerk of the Court at [email protected] immediately upon release of the Supreme Court order if they intend to take an appeal.
