Examiners of the reports of guardians, committees and conservators, also known as Court Examiners, review the initial and annual reports of guardians of incapacitated persons who have been appointed pursuant to Mental Hygiene Law articles 79 or 81.

This review ensures that the guardians have complied with the order of appointment and performed their duties in a satisfactory manner in relation to the personal needs and/or the management of property of incapacitated persons. Pursuant to Mental Hygiene Law § 81.32 (b) and Rules of the Appellate Division, Third Department (22 NYCRR) § 806.30 (a), one or more Court Examiners are appointed for each of the 28 counties in the Third Judicial Department by the Presiding Justice on an annual basis. The Court Examiner Program monitors the work of the Court Examiners and provides support, including continuing legal education, to ensure optimum performance of their duties.
