As of January 1, 1996, there are no longer any exemptions from Jury Duty.

Pursuant to Section 500 of the Judiciary Law

“It is the policy of this state that all litigants in the courts of this state entitled to trial by jury shall have the right to grand and petit juries selected at random from a fair cross-section of the community in the country or other governmental subdivision wherein the court convenes; and that all eligible citizens have the opportunity to serve on grand and petit juries in the courts of this state, and shall have an obligation to serve when summoned for that purpose, unless excused.”

Every qualified citizen is required to serve jury duty unless excused.

One is not qualified to serve as a juror if:

You are not an American Citizen

If you are not an American citizen, please submit one of the following proofs:

A photocopy of your Alien Registration Card (both sides)
A photocopy of your Work Authorization Card
A photocopy of your Visa
A photocopy of your Passport

You are not a resident of Queens County

If you are not a resident of Queens County, please submit two of the following proofs:

A photocopy of your most recent utility bill showing your name and current address
A photocopy of your current lease or mortgage
A photocopy of your voter’s registration card showing your current address
A current tax return (with amounts deleted) showing your current name and address

You have served jury duty within the past 4 years

If you have served jury duty within the past four (4) years, please submit a copy of your Certificate of Service.

You have been convicted of a felony

If you have been convicted of a felony, please submit proof of your felony conviction or a Certificate of Disposition from the court in which you were sentenced.

You are under the age of 18 years

If you are under 18 years of age, please submit a copy of your birth certificate.

Conditional Exceptions/Postponements

Caregiver of a Child

If you are the unemployed parent or guardian and main caregiver of a child under 14 years of age and are requesting to be postponed or excused, please submit a copy of your youngest child’s birth certificate.

If you are employed on a part-time basis or during night hours, please submit a copy of your youngest child’s birth certificate and a letter from your employer stating the days and hours of your employment.

Please Note:
Only one parent is entitled to the caregiver exemption.
Grandparents are only exempt from serving if they have documentation verifying full custody of the minor child

Caregiver of a Disabled Person

If you are the main caregiver of a disabled person, and you are not employed and are requesting to be postponed or excused, please submit a note from a licensed medical professional stating that you are the main caregiver of the disabled person. Paid caregivers are excluded.

Deceased

If the proposed juror is deceased, please provide a copy of the decedent’s death certificate, obituary, or other official certification.

Language

If you are a citizen seeking to be excused on the basis that you are unable to understand and communicate in English, you must report as directed on your summons or subpoena. Further instructions will be given when you appear.

Medical Conditions

If you have a medical condition that prevents you from serving please submit a statement from a licensed medical professional which includes the following: A diagnosis of your mental or physical condition A prognosis of how long the condition is expected to exist A conclusion stating that you are incapable of serving as a juror at this time or in the future.

Military Service

If you are an active member of the military, please submit a copy of the first page of your orders, deleting any sensitive information.

Postponements

First Request

Applications for postponements must be submitted prior to the date on your summons. If you are requesting a postponement for the first time, you can apply: by phone at 1-800-449-2819, on the web at www.nyjuror.gov or by mailing the completed summons to our Mailing Address at the top of this page.

Additional Requests

All requests for additional postponements must be made in person. If your summons indicates “Last Time Absent”, your postponement request must be made in person.

Jury Subpoena Failure to Respond Instructions

If you received a Subpoena For Failure to Respond you MUST follow the reporting instructions on your notice. Personal appearances, at the subpoena locations, are only allowed on the date on your notice.

However:

If you are 75 years of age or older, please submit a copy of your birth certificate.
If you have a medical condition that prevents you from serving, please see the "Medical Conditions" section on this page.

Notice of Non-Compliance Instructions

If you received a Notice of Non-Compliance, you must follow the reporting instructions on your notice.

Payment for Jury Service

The fee for jury service is $72 per day. Jurors who receive their salary during their entire jury service will not be paid by the state.

The employer of a juror, who employees more than 10 people, must pay at least $72 per day for the first three days of jury service.

Jurors, whose employers have more than 10 employees and do not pay their salary or wages after the third day of jury service, will be paid by the state at the rate of $72 per day, for the days not paid by their employer.

Jurors, whose employers have 10 or less employees and do not pay their salary while they serve, will be paid by the state, $72 for each day of attendance.

Checks for jury service are mailed by the Office of the State Comptroller, within four to six weeks of completion of service.
