To Request Mediation:
To seek mediation for a matter pending in Queens Supreme Court, Civil Term, parties must complete BOTH the Stipulation to Mediate and the Addendum. The parties must contact the assigned IAS Justice’s Part email requesting that the case be referred to mediation and request the Court to EITHER issue an Order of Reference OR “So-order” the Stipulation to Mediate. The parties must then notify the ADR Office at [email protected] that the requisite documents are uploaded to NYSCEF and the ADR Office will assign a mediator. Please note that the Matrimonial, Commercial Division and Presumptive/TSP Programs all have specific rules.
Presumptive Mediation
The Court considers many Civil Matters or be resolvable through mediation. Areas covered by “Presumptive Mediation” include disputes about real property, contracts, employment issues including wages and discrimination, personal injury action and motor vehicle accident cases. The Program offers one FREE 90-minute mediation session. See the Program Rules for more information:
Matrimonial Mediation
The Program offers one FREE 90-minute mediation session. The Program is offered ONLY for cases that are already filed and pending before a Matrimonial Judge. The parties may request mediation from the Court at any time during the divorce action. Mediators handle custody, visitation, child support, maintenance and equitable, distribution/property issues. Cases with Orders of Protection, Domestic Violence and Child abuse/Neglect are EXCLUDED from the Program.
