Obtaining Certified Copies of Divorce Judgments
Pursuant to Section 235 of the Domestic Relations Law, documents filed in Matrimonial cases are restricted. However, the listed parties and/or their attorneys of record have access to all filed documents.
Listed Parties and/or an Attorney of Record
In-person requests for certified copies of documents in a divorce by listed parties and/or an attorney of record must provide the following:
- A non–expired, government issued photo I.D. (e.g., State or City ID, Driver’s license, passport).
- The parties first and last names at the time the divorce was filed.
- An index number and/or approximate year the divorce began.
Payment can be made in cash, or by certified check, attorney check, credit card, money order or official bank check in U.S. dollars payable to the New York County Clerk in the amount of .25 cents per page plus $8.00 per certification. The New York County Clerk’s Office does not accept personal or company checks.
A Certificate of Non-Appeal can be requested at the Judgment Department for an additional $5.00 fee.
A Search Certificate is proof that a Judgment of Divorce was not recorded within New York County. It can be requested for a fee of $5 for every two years the record is searched.
Non-Parties
In-person requests by non-parties must provide the following:
- An original notarized letter of request from a party or attorney of record that grants access to the record. The letter of request must have the first and last name of the bearer. The letter of request should include the first and last name of the parties at the time the divorce was filed, an index number or approximate year the divorce began, a contact phone number and/ or email address.
- A non–expired, government issued photo I.D. (e.g., State or City ID, Driver’s license, passport) to the clerk.
Payment can be made in cash, or by certified check, attorney check, credit card, money order or official bank check in U.S. dollars payable to the New York County Clerk in the amount of .25 cents per page plus $8.00 per certification. The New York County Clerk’s Office does not accept personal or company checks.

Exemplified Copies of Documents in a Court Case
Request for exemplified documents must include the following:
- The case caption.
- An index number.
- The title of the document and/or document docket number.
Payment can be made in cash, or by certified check, attorney check, credit card, money order or official bank check in U.S. dollars payable to the New York County Clerk in the amount of $33.00. The New York County Clerk’s Office does not accept personal checks. The exemplified document is generally ready for pick up in two weeks.
Request for exemplified documents by mail must include the following:
- An original letter of request that includes the full company and/or first and last name of the parties, an index number, and the title and/or docket number of the requested exemplified document. The letter of request should also include a contact phone number and/ or email address.
- A certified check, attorney check, money order or official bank check in U.S. dollars payable to the New York County Clerk in the amount of $33.00 per copy. The New York County Clerk’s Office does not accept personal or company checks.
- A self-addressed stamped envelope
Notice of Appeal
The following documents are required to file a Notice of Appeal to the Appellate Division, First Department:
- A Notice of Appeal
- Affirmation of Service After Commencement of Litigation
- An Informational Statement (NYCRR 1250.3[a])
- An entered/ filed stamped copy of the decision/order/ judgment being appealed.
- Affidavit of service
The filing fee is $65.00 per Notice of Appeal. Only one decision/order/judgment may be appealed per Notice. Payment can be made in cash, or by certified check, attorney check, credit card, money order or official bank check in U.S. dollars payable to the New York County Clerk. The New York County Clerk’s Office does not accept personal or company checks.
Subpoena to the Appellate Division, First Department
The filing fee is $25.00 per Subpoena. Please be advised, if this is an e-filed case, a flash drive containing the documents from the NYSCEF record on appeal must be submitted with the subpoena. If you are representing yourself, the Subpoena must be signed by the Judge presiding over your action before filing. Payment can be made in cash, or by certified check, attorney check , credit card, money order or official bank check in U.S. dollars payable to the New York County Clerk. The New York County Clerk’s Office does not accept personal checks.
The following documents are required to file a Subpoena Duces Tecum to the Appellate Division, First Department:
The filing fee is $5.00 per Article 78 Subpoena Duces Tecum. Please be advised, if this is an e-filed case, a flash drive containing the documents from the NYSCEF record on appeal must be submitted with the subpoena. If you are representing yourself, the Subpoena must be signed by the Judge presiding over your action before filing. Payment can be made in cash, or by certified check, attorney check, credit card, money order or official bank check in U.S. dollars payable to the New York County Clerk. The New York County Clerk’s Office does not accept personal or company checks.
The following documents are required to file a Subpoena Duces Tecum for an Article 78 proceeding to the Appellate Division, First Department:
Change of Venue
A case may be transferred to another court by parties’ Demand and Consent, Stipulation or by Court Order. The clerk must be notified of this Order in person or by a mailed letter of request. The filing fee for the transfer is $10.00. Payment can be made in cash, or by certified check, attorney check, credit card, money order or official bank check in U.S. dollars payable to the New York County Clerk. The New York County Clerk’s Office does not accept personal or company checks. If a case is transferred within the five boroughs of New York City (i.e., Bronx County, Kings County, New York County, Queens County, Richmond County), there is no filing fee.
