Search Certificates:
A Matrimonial Search Certificate is issued as proof that a Divorce Judgment or Divorce action was not filed with the New York County Clerk’s office. A search certificate for a Divorce Judgment is $5.00 per two-year search. For example, a search from 1994-2010 would cost $45.00. A search from 2020-2023 would be $10.00. Payment can be made in cash, or by certified check, attorney check, credit card, money order or official bank check in U.S. dollars payable to the New York County Clerk. The New York County Clerk’s Office does not accept personal or company checks.
Certificates of Disposition are available to the public and provide the date a judgment of divorce was signed, filed, and the name of the Judge or Referee who granted the judgment of divorce. A certificate of disposition based on a matrimonial divorce judgment is $8.00. Payment can be made in cash, or by certified check, attorney check, credit card, money order or official bank check in U.S. dollars payable to the New York County Clerk. The New York County Clerk’s Office does not accept personal or company checks.
A Certificate of No Notice of Appeal is available to the public and is used as proof that a judgment of divorce was not appealed. The certificate provides the date the judgment was signed and entered. It does not provide the name of the Judge or Referee who granted the judgment of divorce, nor does it state that all appeals have been exhausted. A certificate of no notice of appeal based on a matrimonial divorce judgment is $5.00. Payment can be made in cash, or by certified check, attorney check, credit card, money order or official bank check in U.S. dollars payable to the New York County Clerk. The New York County Clerk’s Office does not accept personal or company checks.”
Guardianship
All court appointed guardians must submit for filing a completed affidavit of oath and designation before the clerk can issue the Guardianship Commission.
To obtain a certified copy of the oath and designation please contact the certification department. Payment can be made in cash, or by certified check, attorney check, credit card, money order or official bank check in U.S. dollars payable to the New York County Clerk in the amount of .25 cents per page plus $8.00 per certification. The New York County Clerk’s Office does not accept personal or company checks.
Subpoenas based on CPLR 3119/UIDDA
New York CPLR 3119 authorizes the County Clerk to issue a New York subpoena that is based on an out-of-state subpoena.
The New York County Clerk’s office can only issue an out-of-state subpoena when discovery will take place within New York County. Our office does not consider virtual appearances as discovery taking place within New York County. To verify their authenticity out-of-state subpoenas must contain a live or wet signature. Also, the proposed New York Subpoena must contain a full contact list of all the parties in the case. Please be advised, the New York County Clerk’s office does not serve subpoenas. A self-addressed stamped envelope should be provided for the subpoena to be returned.

Money Judgments
For e-filed cases where an order directs entry of judgment, the judgment with affirmed bill of cost and litigation back should be e-filed as a single PDF using the document type “Judgment – To County Clerk (Proposed)”.
Judgments in paper cases can be submitted to the Judgment Department in Room 141b, with the affirmed bill of cost and litigation back.
Matrimonial/Divorce
Before inquiring with the County Clerk’s office regarding a judgment of divorce, please verify the judgment was submitted to our office. Please confirm the County Clerk has received the signed judgment by viewing the case docket on NYSCEF/E-Filed. If the document type reads “Judgment – To Court Clerk (Proposed)”, it is not with the County Clerk. However, if the document type “Judgment – Signed by Court to County Clerk” has been e-filed, this indicates the New York County Clerk’s office has received it. For paper cases/hard copy cases, please check E Courts to verify the New York County Clerk has received the matrimonial/divorce judgment.
